Heard Mr. P. Kumar, learned counsel for the petitioner and Ms. Archana Singh, learned counsel for the Development Authority.
Counsel for the petitioner does not press the writ petition and seeks liberty to the petitioner to approach respondents- Development Authority for seeking permission to raise construction on her plot as provided for in clause (Kha) of Chapter-3 of Vikas Pradhikaran Bhawan Nirman Evam Vikas Upvidhi, 2008 and direction to consider the petitioner's application for permission within time frame.
The petition is disposed of as not pressed. It is open to the petitioner to approach the Development Authority for seeking permission to raise construction on her plot under the aforementioned provision. If the petitioner makes such an application and submits supporting documents including maps/plan, we hope and trust that the concerned Authority shall deal with the same and pass appropriate orders as expeditiously as possible and preferably within a period of 12 weeks from the date of its presentation. It is made clear that the petitioner, under any circumstances, shall not make any construction, unless the permission is obtained from the concerned Authority.
