Smt Sumitra Devi vs Smt Priyanka Priyadarshini

High Court Of Judicature at Allahabad|30 May, 2018
|

JUDGMENT / ORDER

Court No. - 59
Case :- CONTEMPT APPLICATION (CIVIL) No. - 3131 of 2018 Applicant :- Smt. Sumitra Devi Opposite Party :- Smt. Priyanka Priyadarshini, S.D.M.
Counsel for Applicant :- Ramesh Yadav,Vikrant Rana
Hon'ble Yashwant Varma,J.
Heard learned counsel for the applicant.
The sole allegation on which this petition is pressed is that the S.D.M. has failed to take action despite certain individuals encroaching upon the land held by the applicant on lease. Despite repeated queries, learned counsel was unable to apprise the Court of the statutory power vesting in the S.D.M. pursuant to which such an exercise could be undertaken by him and that too in order to settle what is essentially a private dispute.
Consequently, the Court finds no ground to initiate proceedings in contempt.
The petition is dismissed.
Order Date :- 30.5.2018 Arun K. Singh
