2. Learned Standing Counsel for the B.S.N.L submits that pursuant to the direction of this Court, the Sub Divisional Engineer, B.S.N.L has found out another space to shift the earth pit and they are willing to shift the earth pit provided the petitioner pays cost involved for shifting the earth pit.
3. Learned counsel for the petitioner undertakes that petitioner is ready to pay the cost.
4. In view of the above, on payment of cost, the Sub Divisional Engineer shall take appropriate steps to remove the earth pit within a period of two months. The B.S.N.L shall intimate the petitioner in writing the cost involved for shifting the earth pit within a period of one week from the date of receipt of a copy of this judgment.
The Writ Petition is disposed of as above.
