Heard learned counsel for the petitioner; learned A.G.A. for the State-respondent nos.1, 2 and 3; and perused the record.
The instant petition seeks quashing of the FIR dated 29.12.2018 registered as Case Crime No.768 of 2018, under Sections 379 and 411 I.P.C., Police Station Aawnla, District Bareilly.
The allegation in the FIR discloses commission of cognizable offence and the complicity of the petitioner is stated to have come to light on the basis of confessional statement of the co- accused, who was apprehended on the spot whereas the petitioner is stated to have been absconded from the spot. The FIR names the petitioner as well as others.
Under the circumstances, no case for quashing of the FIR is made out.
The petition is dismissed.
