Heard learned counsel for the petitioner; the learned Standing Counsel for the respondent no.1; Sri H. N. Pandey for the respondent nos. 2 and 3; and perused the record.
Considering the nature of the order that is being passed, this Court does not consider it necessary to call for response from the respondents and, with the consent of learned counsel for the parties, this petition is being decided finally, at this stage itself.
The petitioner has prayed for a direction upon the respondent no.3 to correct the father's name of the petitioner so that in place of Ravi Kumar Pandey, it be recorded as Ravindra Kumar Pandey in Secondary School Examination Certificate 2014-16.
Ordinarily, an application for correction of name is to be forwarded by the Principal of the institution concerned on the basis of the school records. But there appears nothing on record to suggest that it was so forwarded.
However, without expressing any opinion on the merits of the claim of the petitioner, this petition is disposed of with liberty to the petitioner to make a comprehensive representation before the third respondent (Assistant Secretary, C.B.S.E., Regional Office, Allahabad). If any such representation is filed along with relevant documents, the third respondent shall call for report from the institution concerned and, thereafter, shall proceed to take an appropriate decision, in accordance with law, preferably, within a period of two months from the date of filing of such representation.
It is made clear that this Court has not expressed any opinion on the merits of the claim of the petitioner.
