Heard Sri Shamimul Hasnain, learned counsel for the petitioner and Sri Amrish Sahai, learned counsel for the respondent-Bank.
By means of this writ petition, the petitioner has come up to this Court raising a grievance that pursuant to notice of the Bank for recovery of loan amount a property was put to auction. The petitioner was the auction purchaser and deposited the amount with the Bank but ultimately it appears that the Bank could not get the property transferred in the name of the petitioner and, therefore, the petitioner required the Bank to reimburse the amount so deposited, which was ultimately refunded to the petitioner by the Bank.
By means of this writ petition, the petitioner is claiming interest on the amount, which the Bank kept with itself as price of the property and the petitioner was the auction purchaser.
The writ petition is disposed of with the direction to respondent no. 2 to consider the claim of the petitioner with regard to the payment of interest and pass appropriate orders in accordance with law as far as possible within a period of three months from the date a certified copy of this order is presented before it.
