Court No. - 6
Case :- WRIT - A No. - 13636 of 2020 Petitioner :- Sumit Kumar Sahu Respondent :- Union Of India And 2 Others Counsel for Petitioner :- Mithlesh Kumar,Neeraj Srivastava Counsel for Respondent :- A.S.G.I.
Hon'ble Ajay Bhanot,J.
Sri Sashi Prakash Singh, learned Additional Solicitor General of India assisted by Sri Rajesh Kumar Singh, learned counsel for the Central Government raises a preliminary objection. It is submitted that the petitioner has an alternative remedy of filing objection before the Central Administrative Tribunal. He relies on the judgment of Hon'ble Supreme Court in the case of L. Chand Kumar Vs. Union of India reported at 1997 (3) SCC 261.
Faced with this Sri Neeraj Srivastava, learned counsel for the petitioner, in his usual fairness, does not dispute the aforesaid proposition of law. He does not press relief sought in the writ petition. He recasts his prayer.
The only prayer made by Sri Neeraj Srivastava, learned counsel for the petitioner is that petitioner may be permitted to avail the alternative remedy.
It is always open to the petitioner to avail the remedy open to him in law.
The writ petition is disposed of.
