Heard Shri R.C. Gupta, learned counsel for the petitioner and learned Standing Counsel for the State respondents.
In view of the order proposed to be passed, notices need not go to private respondent nos.4 and 5.
With the consent of learned counsel for the parties, the writ petition is being decided without calling for counter affidavit.
The petitioner is before this Court for a direction to the third respondent, Tehsildar, Tehsil Sadar, District Varanasi to decide the Restoration Case No.T201814700307463 of 2018 under Section 34 of U.P. Revenue Coed, 2006 within stipulated period. The request has also been made for consolidating and deciding all the restoration cases filed by the petitioner together.
Considering the facts and circumstances of the case and without entering into the merits of the issue, the writ petition is disposed of asking the third respondent to consider and decide the aforesaid case in accordance with law expeditiously and preferably within three weeks from the date of production of certified copy of this order but certainly after giving opportunity to all parties concerned. It is made clear that no unnecessarily adjournment shall be granted in the case and all endeavour should be made to decide the case expeditiously, subject to cooperation of parties as well as convenience/roster of the Court.
In case the petitioner moves an appropriate application before the Collector, Varanasi for consolidating all the restoration applications moved by the petitioners, the same shall also be redressed strictly in accordance with law.
