Heard Sri Omkar Nath Rai, counsel for the petitioner and learned Standing counsel.
By this petition, the petitioner seeks a direction in the nature of mandamus commanding the respondent no.1 Settlement Officer Consolidation, Padrauna, District- Kushinagar to decide the Appeal No. 552/384, within a stipulated period of time.
Contention of the learned counsel for petitioner is that the aforesaid appeal on 6.2.1998 against the order dated 6.11.1997 passed by the Consolidation Officer but no decision has been taken thereon as yet even after lapse of more than 20 years.. Learned counsel prays that some suitable direction may be issued for expeditious disposal of the revision.
In the facts and circumstances of the case, direction is issued upon respondent no.1 Settlement Officer Consolidation,Padrauna, District- Kushinagar to decide the Appeal No. 552/384, in accordance with law expeditiously, preferably within a period of six months from the date of production of a certified copy of this order.
With the above direction, the writ petition stands finally disposed of. No order as to costs.
