Heard Shri Dhananjay Kumar Pandey, learned counsel for the petitioners; learned A.G.A. appearing for the respondent nos.1 and 2 and Shri Dev Kumar, learned counsel for the respondent no.3.
Present writ petition has been preferred for a direction to quash the FIR dated 21.7.2021 being Case Crime No.0360 of 2021 under Sections 313, 498A, 323, 504, 506 IPC & 3/4 Dowry Prohibition Act, P.S. Mangalpur, Distt. Kanpur Dehat and for a direction to respondents not to arrest the petitioners pursuant to aforesaid FIR.
Learned counsel for the petitioners has placed reliance on the order dated 01.9.2021 passed in Criminal Misc. Writ Petition No.7227 of 2021 (Ashutosh Kumar Gupta vs. State of UP and 2 others), wherein the husband of the complainant and son of the first petitioner had approached to this Court for quashing the aforesaid FIR dated 21.7.2021 and the Court had proceeded to dispose of the writ petition with observations that once the matter is ceased before the trial court for mediation then in such situation the Court is not inclined to proceed further in the matter.
So far as factual and legal aspect of the matter is concerned, the same is not disputed by learned counsel for the parties.
Present writ petition is disposed of in terms of the order passed in Ashutosh Kumar Gupta's case (supra).
