Heard learned counsel for the petitioner and perused the record.
The suit was instituted in the year 2002. The issues were framed 12.10.2009.
Learned counsel for the petitioner calls attention to the ordersheet and argues that the matter is not being proceeded with a sense of dispatch. This is delaying in final disposal of the suit. There is no reason that the matter be kept pending indefinitely.
In such view of the submissions the Trial Court is directed to make all endeavours to decide the suit proceedings preferably within a period of one year from the date of production of a certified copy of this order.
The learned Trial Court shall not grant any unnecessary adjournments to the parties. The learned Trial Court shall impose exemplary costs to the parties which seek unnecessary adjournments. If necessary, the Trial Court may proceed on day to day basis to ensure that the proceedings are completed in proximity to the time frame stated in the preceding paragraph.
The writ petition is disposed of.
