Heard learned counsel for the petitioner and learned A.G.A for the State.
This writ petition has been filed by the petitioner with the following prayer:-
"i) Issue to set up independent inquiry to enquire the allegation made by learned District Judge of Judgeship Sonbhadra may be directed to get an independent enquiry conducted against the complaint dated 12.12.2017 in regard to change the relevant portion made in the complaint.
iii) issue any other suitable writ, order or direction as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case.
iii) Award the cost of petition to the petitioner."
After advancing his arguments at some length learned counsel for the petitioner submitted that he may be permitted to withdraw this writ petition with liberty to the petitioner to move an application before Chief Judicial Magistrate, Sonbhadra before whom the application filed by him under section 156(3) Cr.P.C. is pending to hold the enquiry in the matter.
The petition is, accordingly, dismissed as withdrawn with the liberty aforesaid.
