The petitioner herein seeks for quashing of the First Information Report dated 15.07.2021 registered as Case Crime No.179 of 2021 under Sections 363 I.P.C P.S-Saidnagli District- Amroha.
The victim girl is stated to be the major girl and it is contended by the petitioner that he had solemnized marriage with the victim girl after she had left her home on 04.07.2021. The victim girl has not joined the petitioner herein and her whereabouts are not known.
The allegations in the first information report regarding enticing away of a minor girl cannot be examined at the instance of the petitioner. Learned counsel for the petitioner, at this stage, submits that the victim girl is living with the petitioner herein.
The petitioner is, therefore, directed to produce the victim girl before the competent Magistrate on 27.09.2021.
The competent Magistrate shall proceed to record the statement of the girl and do the needful in accordance with law.
With the above observation, the writ petition is, dismissed.
