Heard Sri Mohd. Monis, learned counsel for the petitioner and Sri S.K. Pandey, learned counsel appearing for respondents no. 1 and 2.
The petitioner has preferred the present writ petition with the following reliefs-
i) To issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no. 2 to decide the representation of the petitioner (Annexure no. 4 to this writ petition).
ii) To issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no. 2 to provide scan copy of the answer book of the petitioner.
It is contended by learned counsel for the petitioner that in order to obtain scanned copy of the answer sheet a representation was submitted by him addressed to the Secretary,Examination Regulatory Authority, Allenganj, U.P. Prayagraj and the petitioner tried to serve a copy of the same upon the aforesaid authority alongwith demand draft of Rs.2000/- but the officials of the aforesaid authority refused to accept the same.
Learned counsel for the petitioner relied upon the judgment of this Court dated 20.5.2019 given in Writ A No.8056 of 2019 (Vijay Kumar and 5 others Vs. State of U.P. and another).
In view of the same petitioner is also entitled for the same relief.
Heard learned counsel for the parties.
With the consent of the learned counsel for the parties this writ petition is being disposed of finally at the admission stage itself.
In the facts and circumstances of the case and in the interest of justice, the petitioners are directed to submit a copy of the representation along with original bank draft of Rs.2000/-, and a certified copy of this order, before the respondent no. 2- Secretary, Examination Regulatory Authority, U.P. Alleganj, Prayagraj within a period of two weeks from today. If such a representation is made, the respondent no. 2 is directed to pass appropriate order in accordance with law within a period of three weeks thereafter.
With the aforesaid observations, this writ petition stands disposed of.
It is made clear that this Court has not expressed any opinion on merits of the case and the authority concern shall pass order independently, in accordance with law.
