Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the respondents.
Present writ petition has been filed seeking quashing of the impugned suspension order dated 3.10.2019 passed by the Sub-Divisional Magistrate, Tehsil Sadar, district Auraiya and also to stay the effect of the aforesaid impugned order.
By the impugned order dated 3.10.2019 while suspending the petitioner she was granted 15 days time to submit her reply/objection. By the letter dated 15.1.2019 she has prayed for 15 days further time. It appears that till date the petitioner has not submitted her reply/objection.
Learned counsel for the petitioner sought to argue the case on merits. I am not inclined to entertain the arguments on merits as the petitioner has full opportunity before the competent authority by way of filing her reply/objection alongwith all necessary documents.
Accordingly, present writ petition stands disposed of with liberty to the petitioner to file her reply/objection before the respondent no. 3, the Sub- Divisional Magistrate, Tehsil Sadar, district Auraiya who shall consider the same, in accordance with law, on its own merit, preferably within a period of one month from the date of production of a certified copy of this order.
No costs.
