Heard Learned counsel for the petitioners, learned AGA for the State, Sri R. S. Chaudhary, learned counsel for respondent No.4 and perused the record.
Respondent No.4, Tulsi Ram Chaudhary is personally present before the Court and he has produced the corpus Smt. Suman Chaudhary (petitioner No.1), in compliance to order of this Court, who has been duly identified by Sri R. S. Chaudhary, learned counsel for respondent No.4.
Upon being enquired, corpus, Smt. Suman Chaudhary states that she is graduate. She further states that her date of birth is 10.10.1996. Learned counsel for the petitioners submits that he is not disputing the date of birth of the corpus and her majority. She further states that she knows Kishan Chand (petitioner No.2) and she had performed marriage with him on her own will. She further states that she is not now willing to go with Kishan Chand (petitioner No.2), due to the fact that she came to know after her marriage that petitioner No.2 is already married. She further states that she wants to live with her parents.
In view of above, corpus Smt. Suman Chaudhary is major and she states that she came to know after her marriage that petitioner No.2 is already married, hence she is not now willing to go with him, rather she wants to live with her parents. Hence, the petition is devoid of merit and it is liable to be dismissed.
Accordingly, the writ petition is dismissed.
A copy of this order be provided to the learned counsel for the petitioners today.
