JUDGMENT / ORDER

The petitioner is the second accused in Crime No.24/2011 of the Adoor Excise Range, which is now pending as C.P. No.81/2013 on the file of the Judicial First Class Magistrate Court, Adoor, alleging offences under Section 8 (1) & (2) of the Kerala Abkari Act. The first accused in the said case is her husband. The petitioner submits that though she is prepared to surrender before the Magistrate Court in view of the non bailable warrant already issued against her, there is every likelihood of the Magistrate Court not considering her application for bail on the date of surrender itself. Therefore, the petitioner seeks interference of this Court to direct the Magistrate Court to consider the application for bail on the date of surrender itself. Cr.M.C. NO. 2533 of 2014 2
2. Heard, the learned counsel for the petitioner and the learned Public Prosecutor.
3. Considering the facts and circumstances of the case, this Cr.M.C. is disposed of directing the petitioner to surrender before the Magistrate Court within a period of two weeks from today and the learned Magistrate is further directed to consider the bail application submitted by the petitioner on the day of surrender itself and pass appropriate orders in accordance with law. It is further ordered that the non bailable warrant already issued against the petitioner shall be kept in abeyance for a period of two weeks.
Cr.M.C. is disposed of.
