JUDGMENT / ORDER

The petitioner is aggrieved with the non- issuance of permit granted as per Ext.P1. The Regular permit has been granted on 12.08.2014. The same is said to have been communicated only on 18.12.2014, as is evident from the postal seal available on Ext.P1. In any event, the petitioner has produced a latter model vehicle, for the issuance of the permit, as per Ext.P3. It is averred that the 2nd respondent authority has refused to accept the same on the ground that the production of current records is past thirty days. 2. There is no prescription that records should positively be produced within thirty days and even Rule 159 of the Kerala Motor Vehicles Rules, 1989 provide for production of current records within an extended period of four months. In such circumstance, it is only proper that the current records of the petitioner's vehicle be accepted and the issuance be considered. The petitioner WPC No.33167/2014 ::2::
shall produce the current records which have been handed back to the petitioner, within ten days from today. The authority shall consider the issuance of the permit. In the meanwhile, issuance of the temporary permit shall also be considered and shall be issued within two weeks, if there is no legal impediment.
Writ petition is disposed of.
