JUDGMENT / ORDER

Petitioner is the first accused in Crime No.583 of 2014 of the Kollam East Police Station for the offence punishable under Section 20(b)(ii) B of the Narcotic Drugs and Psychotropic Substance act, 1985 for alleged possession of 2.5550 Kgs. of ganja, is in custody from 23.03.2014 and seeks bail. 2. The learned Public Prosecutor has opposed the application. It is submitted that the petitioner was arrested in front of the Fatima Mata National College, Kollam with the contraband. The second accused who sold the contraband is not so far arrested. Petitioner is also involved in two other cases of similar nature.
3. The learned counsel submitted that the petitioner is entitled to get statutory bail.
4. Since the petitioner is in custody from 23.03.2014 and the final report is not so far filed, he is entitled to get statutory bail.
The application is allowed as under :
I. Petitioner is granted bail in Crime No.583 of 2014 of the Kollam East Police Station and shall be released (if not required to be detained otherwise) on his executing bond for `30,000/- (Rupees thirty thousand only) with three sureties for the like sum each to the satisfaction of the Principal Sessions Judge, Kollam and subject to the following conditions .
a. Whether or not he/she has landed property, one of the sureties shall be the father/mother/brother/close relative of the petitioner.
b. Petitioner shall report to the officer investigating Crime No.583 of 2014 of the Kollam East Police Station on every Monday and friday between 3 p.m. and 5 p.m. until otherwise ordered by the learned Principal Sessions Judge, concerned.
c. Petitioner shall report to the investigating officers as and when required for interrogation.
d. Petitioner shall not get involved in any offence during the period of this bail.
e. Petitioner shall not intimidate or influence the witnesses.
f. In case any of condition Nos.(b) to (e) is violated, it is open to the investigating officer to file application before the learned Principal Sessions Judge for cancellation of the bail granted hereby, as held in P.K.Shaji v.State of Kerala [AIR 2006 SC 100].
