Heard Akhil Kumar Shukla, learned counsel for the applicant and learned AGA for the state and perused the record.
It has been submitted by learned counsel for the applicant that the applicant has been falsely implicated in the present case. Only the evidence against the applicant is last seen evidence. The trial has not yet been concluded. The applicant is in jail since 23.1.2013.
Learned AGA vehemently opposed the prayer for bail and submitted that the trial of the case is in progress. If the applicant is released on bail, it would hamper running of the trial.
Without expressing any opinion on the merits of the case and considering the submissions advanced, I find that no good ground is made out for enlarging the applicant on bail.
The bail application of the applicant Suleman @ Khalifa @ Hakkal son of Washir involved in Case Crime No. 1295 of 2008 (ST No. 264 of 2012), under Section 302 IPC, police station Tirva, district Kannauj is, accordingly, rejected.
The trial court is directed to expedite the trial of the present case and conclude the same expeditiously preferably within a period of six months fromthe date of production of a certified copy of this order before him, if there is no legal impediment.
