The O.P(FC) is filed for a declaration that the Family Court, Mavelikara has no jurisdiction to entertain O.P No.176/2014. The case of the petitioner is that the respondent being a divorced wife, she was not entitled to approach the Family Court in O.P.No.176/2014.
2. The petitioner can very well raise the contention of lack of jurisdiction before the Family Court itself. It is for the Family Court to consider the same initially. We do not think that this O.P(FC) requires to be entertained at this stage. It is accordingly closed with liberty to the petitioner to raise all his contentions before the Family Court.
3. The learned counsel for the petitioner submitted that if such a contention is raised before the Family Court, it will take a long time in the Family Court to decide the same. We do not think that the apprehension of the petitioner is well founded.
O.P(F.C) No.240 of 2014 2 The Family Court will certainly consider the contention about the question of jurisdiction and pass appropriate orders expeditiously.
The O.P(FC) is disposed of.
