Sukjibhai vs State

High Court Of Gujarat|25 January, 2012

JUDGMENT / ORDER

Learned advocate for the petitioner has invited this Court's attention to averments made by the petitioner, on oath at Paragraph Nos.3.1, 3.2 and 4 and submitted that though the application accompanied with Map the authority has taken a strange stand, as if the Map was not there with the application. If this is the case, then it amounts to undue harassment.
Hence, let there be a notice for final disposal, returnable on 10.02.2012. As the notice is being issued for final disposal, it is expected of the respondents to be ready with the affidavit-in-reply especially on the point which is mentioned hereinabove in respect of the contention that the Map in fact was accompanying the application. Learned AGP waives service of notice on behalf of respondent no.1. Direct service qua respondent no.2 is permitted.
