JUDGMENT / ORDER

Court No. - 38
Case :- WRIT - C No. - 17090 of 2012 Petitioner :- Sukhveer And Others Respondent :- State Of U.P. And Others Counsel for Petitioner :- A.N.Mishra,Satyendra Kumar Mishra Counsel for Respondent :- C.S.C.,Anoop Trivedi,Ashwani Kr.Misra,Mahendra Pratap
Hon'ble Abhinava Upadhya,J.
Hon'ble Dr. Yogendra Kumar Srivastava,J.
Heard Shri A.N. Mishra, learned counsel for the petitioners; Shri Harshwardhan holding brief of Shri Anoop Trivedi, learned counsel appearing for the Ghaziabad Development Authority- respondent no. 2 and learned Standing Counsel for the State- respondents no. 1, 3 & 4.
By means of this writ petition the petitioners have come to this with the prayer that subsequent to acquisition of land of the petitioners certain other benefits and rehabilitation should be done according to various government orders, filed as Annexure 6 to the writ petition.
It is not disputed that land acquisition proceedings were initiated by a notification under Section 4 of the Land Acquisition Act, 1894 on 27.11.2009. Under the prevalent Karar Niyamawali an agreement was arrived at and sale deeds were executed.
That being the case, once agreement has been arrived at and amount has been paid, no further amount is liable to be paid to the petitioners after such agreement.
In view of the aforesaid, no case is made out for interference at this stage.
The writ petition lacks merit and it is, accordingly, dismissed.
Order Date :- 30.1.2019 Sunil Kr. Gupta (Dr. Y.K. Srivastava, J.) (Abhinava Upadhya, J.)
