Heard Sri Rama Shankar Mishra, learned counsel for the applicants, Sri C.P. Pandey, learned counsel for the private respondent, Sri Prashant Kumar, learned A.G.A. appearing for the State and perused the record.
This application under Section 482 Cr.P.C has been moved with a prayer to quash the entire criminal proceedings of Complaint Case No.103 of 2018 under sections 379, 427, 506 IPC, Police Station Hafizpur, District Hapur, pending in the court of Judicial Magistrate II, Hapur, and also a prayer is made to stay the proceedings in this case till the disposal of this application.
It is contended by the learned counsel for the applicant that he does not want to press this application and the same may be dismissed as withdrawn with liberty to file the fresh.
The application is accordingly rejected as not pressed with liberty to file a fresh.
Office is directed to return the certified copy of the impugned order retaining a photocopy of the same.
