Heard Sri Lalit Kumar Srivastava, learned counsel for the petitioners, Sri N.K. Verma, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioners with a prayer to quash the F.I.R. dated 11.6.2017 registered as case crime no.437 of 2017 under sections 420, 467, 468, 471, 120-B, 147, 148, 149 I.P.C., police station Hari Parvat, District Agra.
Learned counsel for the petitioners submits that the petitioner no. 1 was working as Sanitary Inspector (Safai Nayak) in the Nagar Nigam and was elected as 'Zila Adhyakash' of Safai Mazdoor Sangh and the respondent no. 3 was elected as 'Nagar Adhyaksh' of Safai Mazdoor Sangh and when he started taking money for providing jobs in Nagar Nigam, several complaints were made by the petitioners against him, hence as a counter- blast the present FIR has been lodged after seven years on an application filed by the respondent no. 3 under section 156 (3) Cr.P.C.
Learned A.G.A. opposed the prayer for quashing.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioners shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but they shall co-operate with the investigation of the case.
With the above direction this petition is finally disposed of.
