Heard Sri Sushil Kumar Mishra, learned counsel for the petitioner.
This petition has been filed for a direction to the Civil Judge (Junior Division) Kasya, Kushinagar to decide Case No. 699 of 2018 (Sukhraji Vs. Narsingh) pending before him within a stipulated period.
Admittedly, the suit was filed on 4.5.2018. The certified copy of the order sheet has not been enclosed with this petition. However, from perusal of the records, it appears that the written statement was directed to be filed by the defendants. The suit has been filed under Section 31 of the Specific Relief Act for cancellation of testamentary instrument.
The petitioner has rushed to this Court without waiting for the proceedings to continue before the court below.
We do not find any reason to interfere in this petition and this petition is, accordingly, dismissed.
