Heard learned counsel for the applicant, learned AGA for the State and perused the material placed on record.
The present bail application has been filed by the applicant in case crime No. 588 of 2016 under Section 498A, 304B IPC and Section 3/4 D.P. Act, police station Sipari Bazar, district Jhansi with the prayer to enlarge him on bail during the pendency of trial.
Learned counsel for the applicant contends that all the witnesses of fact have become hostile. The applicant who is husband has been falsely implicated and the deceased had committed suicide. It is contended that apart from ligature mark there is no injury on the body of the deceased.
After hearing the learned counsel for the applicant, learned A.G.A. and after perusing the bail rejection order,first information report as well as averments as contained in the present bail application, this Court is of the opinion that the learned counsel for the applicant could not make out any good ground for enlarging the applicant on bail at this stage.
Accordingly, the bail application is hereby rejected.
After the order was passed learned counsel for the applicant prayed that the trial of the aforesaid case may be expedited.
Accordingly, court below concerned is directed to conclude the trial of the aforesaid case, expeditiously, strictly in accordance with law, after hearing the parties and without granting unnecessary adjournment to either the parties, provided the proceedings are not stayed by any court of law.
