Sukhjinder Jit Kaur vs Rajinder Singh And 6 Others

High Court Of Judicature at Allahabad|11 November, 2014

JUDGMENT / ORDER

Heard learned counsel for applicant.
The grievance of the applicant is that the opposite party-contemnors have willfully and deliberately flouted the order of the Writ Court dated 30.10.2007 passed in Civil Misc. Writ Petition No. 37760 of 2007, copy of which order has been filed as annexure-1 to the affidavit accompanying this application whereby the writ Court had directed the parties to maintain status quo with regard to nature and possession of the land in dispute.
Learned counsel for the applicant contends that pursuant to the aforesaid order of the status quo, order of mutation in respect of concerned party was passed on 17.7.2014. It is next contended that in spite of the fact that the opposite parties were aware of the mutation order as well as the order of the writ Court, they have executed sale deeds on 30.8.2014 and 01.9.2014 which is in violation of the order of the writ Court dated 30.10.2007, which tantamounts to willful and deliberate contempt of the order of this Court.
Issue notice to opposite parties No. 1 to 7 returnable within four weeks. Steps be taken within a week.
The opposite party Nos. 1 to 7 may file counter affidavit within the aforesaid period. Rejoinder affidavit, if any, may be filed within two weeks thereafter.
List after the expiry of the aforesaid period.
Order Date :- 11.11.2014 faraz
