Heard learned advocate for the applicants and it is submitted that as per order dated 10th June, 2011 passed by learned 6th Additional Senior Civil Judge, Jamnagar below Exh.5 and Exh.23 in Regular Civil Suit No.43 of 2011 the injunction is granted in favour of the applicants, defendant therein. The above order is not subject matter of challenge before any forum.
The impugned complaint is filed on 1st August, 2011 is nothing but abuse of process of law.
Considering the above aspect, at this stage I am inclined to issue notice returnable on 17th February, 2012.
Meanwhile, there shall be ad-interim relief in terms of para 7(B).
