Heard learned counsel for the petitioner, Sri Baleshwar Chaturvedi learned counsel for the respondent No.3 and the learned A.G.A.
Present writ petition has been filed for quashing the F.I.R. dated 16.1.2018 which has been registered as case crime No. 25 of 2018 under Section 135 Electricity Act, police station Alaoo, district Mainpuri.
It is contended by learned counsel for the petitioner that the allegation against the petitioner is that of consuming electricity without obtaining the electricity connection.
Learned counsel for the respondent No.3 Sri Baleshwar Chaturvedi contends that the petitioner who is consuming electricity has not paid any amount.
After hearing the learned counsel for the parties and after perusing the material on record,this writ petition is disposed of with a direction that in case the petitioner moves application for compounding as per law within a period of one month from today before the authority concerned, the same shall be considered and appropriate orders be passed by the respondent No.3, as per law, within a period of one month thereafter.
Subject to moving appropriate application as stipulated above, coercive action against the petitioner shall be kept in abeyance for a period of two month till the decision of application of the petitioner whichever is earlier.
In case the petitioner does not move appropriate application, as stipulated above, protection granted above shall automatically stands vacated.
Present writ petition stands disposed of.
