This writ petition has been filed seeking a direction upon Sub Divisional Magistrate, Tehsil Dhanaura, District Amroha for deciding the application dated 02.07.2019, which has been filed under Section 79/80 of the U.P. Revenue Code, 2006.
It is contended by counsel for the petitioners that the forefather of the petitioners were granted lease in the year 1978 over the land in dispute and they were recorded in the revenue record in the category 4-A. The petitioners are claiming bhumidhari rights over the land in dispute since they are in possession over the land for more than 40 years.
As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit or issuing notice to respondents, with a direction upon respondent no.3 to decide the aforesaid application of the petitioners, if there is no legal impediment, after hearing all the concerned parties, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of four months from the date of production of copy of this order, downloaded from the official website of Allahabad High Court.
Writ petition stands disposed of.
