The report of the Chief Judicial Magistrate, Bulandshahar dated 25.06.2018 is on record indicating that the appellant No. 1, Sukhan Singh and appellant No. 2, Tunda Singh had expired in the year 2007 and 2009 respectively.
The report has been submitted in consonance with the circular of this Court as such the appeal stands abated against Sukhan Singh and Tunda Singh.
Let bailable warrant be issued against the appellants, namely, Raj Pal Singh and Shripal, who shall surrender before the court below within four weeks and in case they apply for bail, they shall be released on bail on furnishing a personal bond of Rs. 20,000/- and two reliable sureties each in the like amount to the satisfaction of the court concerned with an undertaking that they shall appear before the Court on the next date fixed.
The Chief Judicial Magistrate, Bulandshahar shall ensure the presence of the accused appellants on the next date fixed as directed vide order dated 08.03.2018.
List this case on 25.09.2018 before appropriate Bench along with office report.
The office is directed to communicate this order along with the order passed on 08.03.2018 with full particulars through FAX to the Chief Judicial Magistrate concerned forthwith for necessary compliance.
