JUDGMENT / ORDER

Court No. - 4
Case :- SPECIAL APPEAL No. - 715 of 2007 Appellant :- Sukh Darshan Jain Respondent :- U.P. State Road Corporation Tehri Kothi & Another Counsel for Appellant :- Samar Singh Counsel for Respondent :- Samir Sharma
Hon'ble Bala Krishna Narayana,J. Hon'ble Irshad Ali,J.
Heard.
Perused the record.
The instant special appeal has been filed by the appellant Sukh Darshan Jain challenging the validity and legality of the order dated 04.05.2007 passed by learned Single Judge of this Court in Civil Misc. Writ Petition No. 26454 of 1992 preferred by the appellant before this Court challenging the order dated 13.05.1992 passed by respondent no.2 by which the appellant was removed from services after enquiry with the finding that he had worked against the interest of respondent no.1, U.P. State Road Transport Corporation and remained absent without prior sanction of leave.
The learned Single Judge after examining the matter from all its aspects and the law on the issue, held by the impugned order that the petitioner had an alternate and expeditious statutory remedy of raising an industrial dispute before the Central Government Industrial Tribunal and dismissed the writ petition on the ground of alternate remedy.
Upon perusal of the impugned order, we do not find that the same suffers from any illegality or legal infirmity requiring any interference by this Court.
This appeal lacks merit and is accordingly dismissed.
