Petitioner's vehicle bearing registration No.KL-2AA-5918 has been seized alleging contravention of the provisions of the Kerala Conservation of Paddy Land and Wet Land Act, 2008. Petitioner relies on draft data bank and submits that this is a land reclaimed 12 years ago and therefore no provisions of the Act 28 of 2008 is attracted.
2. In view of the above for the purpose of interim custody, District collector shall take a decision after verifying the draft data bank of the property within a period of one week from the date of receipt of a copy of this judgment. If it is found on verification of the draft data bank that the petitioner's vehicle is not involved in contravention of the provisions of the Act 28 of 2008, vehicle shall be released to the petitioner. Needful shall be done within a period of ten days.
The Writ Petition is disposed of.
