Sujeet Singh vs Renu Katariya

High Court Of Judicature at Allahabad|23 December, 2021
|

JUDGMENT / ORDER

Court No. - 39
Case :- FIRST APPEAL No. - 1012 of 2021 Appellant :- Sujeet Singh Respondent :- Renu Katariya Counsel for Appellant :- Vivek Singh
Hon'ble Mrs. Sunita Agarwal,J. Hon'ble Vikas Budhwar,J.
No one has put in appearance on behalf of the appellant to press the present appeal.
This appeal is directed against an order passed under Section 24 of the Hindu Marriage Act, whereby in a proceeding under Section 9 of the Hindu Marriage Act, the cost of the proceeding has been provided to the respondent-wife in lump sum of Rs. 14,000/- in addition to Rs. 400/- which is to be paid for each date of appearance.
We do not find any reason to interfere in the order impugned, inasmuch as, in a proceeding drawn by the husband, the respondent wife is entitled for the cost of the proceeding in view of the provisions of Section 24 of the Hindu Marriage Act. Moreover, the amount fixed cannot be said to be excessive.
The appeal is, accordingly, dismissed at the admission stage itself.
