Heard learned counsel for the applicant, learned AGA for the State and Sri Radhey Shyam Dwivedi, learned counsel for opposite party no.2.
Applicant has moved the present bail application seeking bail in Case Crime No. 308 of 2019 u/s 363, 366, 376 IPC and 7/8 POCSO Act PS Shivpur District Varanasi.
Learned counsel for the opposite party no.2 has informed the Court that he has instructions to appear on behalf of the girl also. It has been contended by both the parties that as per the medical the girl is adult and she has solemnized marriage with the applicant.
Learned AGA has opposed the bail application of the applicant, however he does not dispute the said fact.
In view of the aforesaid facts and circumstances, without expressing any opinion on the merits of the case, at this stage, prima facie, a case for bail has been made out. However, the said prima facie view of this Court will not in any manner adversely affect the case of the prosecution.
The prayer for bail is granted. The application is allowed.
Let the applicant Sujeet Kumar @ Lalla involved in the aforesaid case crime number be released on bail on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
