The petitioner has done diploma course in Community Medical Services and Essential Drugs. He has preferred this writ petition for a direction upon the Chief Medical Officer to grant permission/no objection certificate to him to practice/treat common disease.
For redressal of his grievance he has filed a representation dated dated 16.09.2018 to the respondent no.2. The only prayer made by the petitioner is that his representation may be directed to be considered by the respondent no.2.
We have heard the learned counsel for the petitioner and the learned Standing Counsel. With their consent the matter is taken on the Board for final disposal at this stage in terms of the Rules of the Court.
Having due regard to the facts of the case, we are of the view that the ends of justice would be subserved by issuing a direction to the respondent no.2 to take appropriate decision expeditiously on the petitioner's representation in the light of the judgment of the Supreme Court in Subhashis Bakshi Vs. West Bengal Medical Counsel, 2003 (9) SCC 269. The petitioner shall submit a certified copy of this order along a xerox copy of the aforesaid judgment of the Supreme Court within two weeks from today before the respondent no.2.
The wit petition is, accordingly, disposed of.
