Prl. Judge, Family Court Bangalore dtd.25.3.2013 passed on I.A.No.IV in M.C.No.3994/2010 and further order to enhance the maintenance amount of Rs.1,500/- for Rs.10,000/-.
This writ petition coming on for Preliminary Hearing ‘B’ Group, this day, the court made the following:
O R D E R None for the parties. Records perused.
In this writ petition, petitioner, inter alia, seeks modification of the order dated 25.03.2013 passed by the Family Court in M.C.No.3994/2010 directing payment of maintenance at the rate of Rs.1,500/-per month and also to enhance the maintenance amount from Rs.1,500/- to Rs.10,000/-.
2. Facts giving rise to filing of this petition briefly stated are that the respondent filed a petition under Section 13 of the Hindu Marriage Act, 1955 (hereinafter referred to as ‘the Act’ for short) in the year 2010. In the aforesaid proceedings, order was passed on 25.03.2013 directing payment of maintenance at the rate of Rs.1,500/-. Being aggrieved, the petitioner has filed this petition seeking modification of the order passed by the Family Court and also for enhancement of the amount of maintenance from Rs.1,500/- to Rs.10,000/- per month.
3. Writ petition is pending before this Court since 2013, in which no interim order has been passed. By now the proceeding which was instituted in the year 2010 might have concluded. In case the proceeding has not been concluded, the Family Court is directed to conclude the same expeditiously within a period of four months from receipt of copy of the order passed today.
Office is directed to transmit copy of this order to the Family Court concerned.
Accordingly, the writ petition is disposed of.
