The present 482 Cr.P.C. application has been filed to quash the entire proceedings of the Criminal Case No. 1385 of 2008 arising out of the Case Crime No. 447D of 2008 under section 406,504,506 I.P.C. P.S. Hapur Nagar district Hapur State Vs. Liyakat and others pending in the court of Chief Judicial Magistrate, Hapur.
Learned counsel for the applicants submits that he has been falsely implicated by the police under the alleged sections.The dispute is of civil nature. For the same offence separate cases have been have been filed against the applicants.
In that view of the matter, they are permitted to move discharge application through counsel before the trial Court within a months from today and the trial court shall decide the same within a period of two months from the date of filing of application alongwith certified copy of this order.
Till the discharge application is decided, no coercive measures shall be taken against the applicants.
The learned counsel for the applicants further prayed that all the trial may be concluded together.
It is observed that it is open for the applicant to move proper application in this regard before the court below.
With the aforesaid observations, this application is disposed of.
