Heard learned counsel for the petitioners, learned A.G.A. and perused the material placed on record.
This petition has been filed for quashing of the FIR relating to case crime no.442 of 2010 under Sections 147,452,323,504,506 and 427 I.P.C., Police Station Jagdishpur,district Sultanpur. A perusal of the FIR discloses commission of cognizable offence, as such the same cannot be quashed. Petitioner No.1 happens to be the village Pradhan against whom false report has been lodged. Otherwise the offences are triable by Magistrate and are not so grave.
In view of above facts and circumstances of the case, this petition is disposed of finally with a direction that petitioners ( Suhel, Rukhsar,Pappu, Smt. Saidul, Raees and Sultan) shall not be arrested in Case Crime No. 442 of 2010 under Sections 147,452,323,504,506 and 427 I.P.C. lodged at Police Station Jagdishpur,district Sultanpur, till credible and cogent evidence is collected against them, subject to their co-operation in the investigation which shall go on.
