Heard learned counsel for the petitioners and Shri Bipin Bihari Pandey, learned Additional Chief Standing Counsel for the State respondents.
Petitioners are before this Court is with the request to ask the second respondent to decide the Review Application filed by the petitioners on 30.07.2016 in Suit no.2156, which was decided on 06.09.1963 under Section 34 of U.P. L.R. Act (Mohd. Iliyas vs. Mohd. Mobiha Bibi), expeditiously.
At the very outset, learned Standing Counsel raised a preliminary objection that once the suit in question has been decided way back on 06.09.1963, then at this stage, after the lapse of more than 50 years period, the review application cannot be entertained and as such, the Writ Petition is liable to be dismissed on this ground alone.
On such an objection, this Court has proceeded to peruse the record in question and finds that admittedly the review application has been filed after more than 50 years period and at this stage, much water has flown in the matter and as such, no order for expeditious disposal of the review application can be passed by this Court.
With these observations, the writ petition is
dismissed.
