After some argument, Sri Arvind Srivastava, learned counsel for the petitioner states that he wants to withdraw the writ petition with liberty to file an appeal under Section 56 of the Indian Stamp Act.
In view of the above, writ petition is dismissed as withdrawn with liberty to petitioner to approach the appellate authority.
However, it is provided that in case, the petitioner approaches the appellate authority within 15 days from today, the appellate authority shall not go into the question of limitation and strictly decide the appeal on merits.
