Case is taken up through video conferencing.
Heard learned counsel for petitioner as well as learned A.G.A. for the State.
Writ petition has been filed seeking following reliefs:-
'i) issue a writ, order or direction in the nature of mandamus commanding the opposite party no.2 to 4 to consider the case of the petitioner and registered the first information report against the private respondent on the basis of application dated 22.3.2021 contained as annexure no.1 to this writ petition in the light guidelines and law laid down by the Hon'ble Apex court in the case of Lalita Kumari Vs Government of Uttar Pradesh and other reported in (2014) 2 SCC 1, in the interest of justice.
ii) issue a writ, order or direction in the nature of mandamus commanding the opposite party no.2 to 4 to take take appropriate action in the matter and protect the life and liberty from the private respondent, in the interest of justice. ......"
We are of the considered view that the petitioner has a statutory remedy of filing complaint under Section 156(3) Cr.P.C. which he has not availed. No reasons have been disclosed as to why the petitioner can not approach the court concerned for redresssal of his grievance.
The writ petition is accordingly dismissed, however with liberty to petitioner to avail the remedy as available to him under Section 156(3) Cr.P.C.
