Petitioner is the accused in C.C. No.902 of 2013 on the file of Judicial First Class Magistrate Court - II, Perinthalmanna which arose out of crime No.168 of 2013 of Melattoor Police Station registered under Section 325 of the Indian Penal Code. Annex. 2 is the final report. Prosecution case in short is that on 15.2.2013 the accused who was working as drawing teacher in a school slapped on the cheek of a student causing injury on the left ear.
3. Heard the learned counsel for the petitioner and the mother of the injured boy. It is submitted by both sides that the Crl.M.C. No.2608 of 2014 :2:
matter has been settled. Annex.3 is the affidavit sworn to by mother of the boy, who sustained injuries. She stated that the boy sustained injuries in a different incident and the complaint happened to be filed on a misunderstanding of facts. Considering the averments in the affidavit and the submissions made by the counsel for the parties, I find that no purpose will be served in further prosecution of the case.
In the result, this petition is allowed. Annex. 2 final report in C.C. No.902 of 2013 on the file of Judicial First Class Magistrate Court - II, Perinthalmanna is hereby quashed.
