Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the respondents and have perused the record.
Present petition has been filed with a prayer to direct the respondents to make appointment of the fair price shop in favour of the petitioner on compassionate ground within a fix period and to pass appropriate order on the representation made by the petitioner dated 30.11.2020 for allotment of fair price shop on compassionate grounds within a fixed period.
Petitioner herein is widow of original fair price shop dealer-Jai Prakash, who died on 12.11.2020. She is claiming appointment under the Dying in Harness category and claiming that she is eligible for such appointment. Petitioner claims that she is eligible for such appointment in the light of latest government orders issued by the State Government.
Perusal of the record indicates that her application for grant of fair price shop licence on compassionate ground is pending consideration.
In view of the aforesaid, without going into the merits of the claim of the petitioner, this petition stands disposed of with a direction to the authority concerned to complete the proceedings in accordance with law on its own merit, preferably within a period of two months from the date of filing of a certified copy of this order.
It is made clear that this Court has not examined the merits of the claim of the petitioner, which shall be looked into by the authority concerned while deciding the claim of the petitioner.
With the aforesaid observation/direction, this writ petition is finally disposed of. No order as to costs.
