Heard Sri Preet Pal Singh Rathore learned counsel for the petitioner and learned Standing counsel for the State respondent.
The present petition has been filed with the following relief:
"(i) issue a writ, order or direction in the nature of mandamus directing or commanding the respondent no.2, 3, 4 and 5 to make recounting of the votes of the member of Block Development Committee Kshetra Panchayat, Ward No.61, Jhontipur and Chandpur, Block Maharajganj District Azamgarh denovo immediately within some specific time."
In our considered opinion, the relief prayed herein can only be granted in case the petitioner approaches the Election Tribunal by filing election petition in accordance with law.
The writ petition is, accordingly, dismissed.
