JUDGMENT / ORDER

1. Learned Counsel Shri Mukul Sinha states that he has instructions to appear for Respondent No.2 and some time may be granted.
2. Therefore, the matter is adjourned to 5th December, 2012 with the consent of learned Senior Advocate Shri N.D.Nanavaty for the Applicant.
3. Learned APP Mr. H.L.Jani has stated that when the order was passed by this Court on 10th October, 2012, he has been arrested before the order could be communicated and he has also been released on bail.
4. Therefore, taking note of this, the matter is adjourned to 5th December, 2012 with liberty to apply in case of difficulty.
