1. Heard Sri Ashok Khare, learned Senior Counsel assisted by Shantanu Khare, learned counsel for the petitioner, Sri Rajesh Yadav, Advocate and learned Standing Counsel for the respondents.
2. Grievance of the petitioner appears to be that he had been suspended on 18.07.2018, however, his suspension order has neither been revoked nor he is being allowed to rejoin his services despite being enlarged on bail. In this regard, petitioner also appears to have filed representation before respondent no. 4 on 31.07.2018 (Annexure No. 8 to the writ petition). Learned counsel for the petitioner has placed reliance upon Rule 3(b) of the Uttar Pradesh Government Servant (Discipline and Appeal) Rules, 1999 as is applicable to the case of the petitioner by virtue of Rule 5 of Uttar Pradesh Basic Education Staff Rules, 1973.
3. In view of the above, no useful purpose would be served in keeping the matter pending or call for any counter affidavit at this stage. Accordingly, the writ petition is disposed of with direction to respondent no. 4 to pass a reasoned and speaking order on the petitioner's representation dated 31.07.2018 (Annexure No. 8 to the writ petition) as expeditiously as possible, preferably within a period of three weeks from the date of production of certified copy of this order.
