Heard learned counsel for the applicant.
Admittedly, the claim laid before the concerned D.I.O.S. is for filling a Class-IV post. This prayer cannot possibly be considered by the D.I.O.S. in light of the amendment to the Regulation 101 as contained in the regulations framed under the provisions of the 1921 Act. It is also not disputed that the validity of Regulation 101 is pending consideration before this Court in a batch of writ petitions.
Consequently, this Court, in the absence of any challenge laid to the said provision or a declaration rendered by the Court that the same is invalid, finds no ground to initiate proceedings in contempt.
The contempt petition is dismissed.
