The prayer made in the instant petition is for issuing direction to the Principal Judge, Family Court, Bijnor to decide Matrimonial Case No. 1010 of 2016 filed by the petitioner under Section 13 of the Hindu Marriage Act, 1955 (herein after referred to as the Act, 1955) against respondent no. 2, within a specified time frame.
A perusal of the order-sheet reveals that the matter is being posted for filing of written statement/settlement of issues/disposal of application under Section 24 of the Act, 1955. It also appears that the court is lying vacant at the present moment.
Having regard to the above facts, the instant petition is disposed of by providing that as soon as a new Presiding Officer is posted in the court, he shall proceed to decide the application under Section 24 of the Act by fixing short dates and without granting unnecessary adjournments. He shall thereafter proceed to decide the main case in accordance with the mandate of Section 21-B of the Act.
